Can you build on a 9m plot in Romania?

Whether it is possible to build on a plot of land with an opening of only 9 meters is a legally complex matter that requires a careful analysis of the applicable legal provisions, including those contained in the General Town Planning Regulation of 27 June 1996, republished.

According to Art. 25 para. (1) of the General Regulation on Town Planning, “Authorization for the execution of constructions is allowed only if there are possibilities of access to public roads, directly or by easement, according to the intended use of the construction. The characteristics of access to public roads must allow the intervention of fire-fighting means.” This provision establishes as a mandatory condition for the authorization of the construction to provide access to public roads, either directly or by means of an easement, access being necessary both for the purpose of the construction and for the effective intervention of fire-fighting means.

However, Article 25 para. (2) of the same normative act provides for an exceptional situation, stating that “Exceptionally, the execution of constructions may be authorized without fulfilling the conditions set out in paragraph (1), with the approval of the territorial fire brigade unit“. Thus, in exceptional cases, a building permit may be obtained even if access to public roads does not meet the standard conditions, but only on the condition that the opinion of the territorial fire brigade unit is obtained.

Another important aspect to be taken into account is the subdivision of land. Art. 30, para. (2) of the General Town Planning Regulation sets out the cumulative conditions that each lot resulting from the subdivision of a plot of land must fulfill in order to be considered buildable. One of these conditions, set out in point a), refers to the minimum opening of the street frontage, which must be at least 8 m for buildings in a row and at least 12 m for detached or coupled buildings.

In the case of a plot of land with an opening of only 9 meters, if it is intended to erect a detached or coupled building, this condition is not met, the resulting lot not falling within the provisions of Art. 30, para. (2), letter a) of the General Regulation on Town Planning. Therefore, the land in question cannot be considered a building lot according to art. 30, para. (3) of the same normative act.

Moreover, in addition to the provisions contained in the General Town Planning Regulation, in order to build on a plot of land with an opening of 9 meters, there are several other important considerations to be taken into account:

Local regulations – it is mandatory to check the planning regulations specific to the area where the land is located. These include the General Urban Development Plan (PUG) or Zonal Urban Development Plan (PUZ) which set out the building conditions, including mandatory setbacks from the plot boundaries, the percentage of land occupation (POT) and the land use coefficient (CUT). These will determine the size and type of building you can build.

Type of construction – on a plot of land with a span of 9 meters, the construction will have to be adapted to respect the legal distances from neighbors and to ensure the functionality of the interior spaces.

Access and utilities – make sure that the plot has adequate access to the public road and the necessary utilities (water, sewerage, electricity, gas, etc.).

Consult a specialist – it is advisable to work with an architect or urban planner to design a plan that complies with all legal regulations and optimizes the available space. A professional can help you comply with the complex urban planning rules and obtain all necessary approvals.

Obtaining permits – before you start building, you will need to obtain planning permission from the local authorities. This process may include submitting building plans, impact studies and other documents required by local authorities.

Thus, the possibility of building on a plot of land with an opening of only 9 meters is subject to significant legal restrictions, the possibility of building on a plot of land with an opening of only 9 meters is extremely limited from a legal point of view. In order to get an answer to this question, it is advisable to apply for a planning certificate from the competent local authority before purchasing a plot of land with a small opening. This document will provide information about the building possibilities and the conditions to be met.
