2024: TRANSFER OF LAND FROM OUTSIDE TO INSIDE IN ROMANIA
The process of transferring land from extravilan to intravilan is regulated by Order No. 1.343 of August 31, 2018, issued by the Ministry of Agriculture and Rural Development. This normative act establishes the legal framework for the calculation and application of the fee due for both the definitive or temporary removal of extravilan land from the agricultural circuit and the introduction of agricultural land into the intravilan.
The legislation in force requires most applicants, whether natural or legal persons, to pay this fee. However, there are certain exceptions, expressly provided for by law, where exemptions from the fee are granted. To ensure the transparency and fairness of the process, the amount of the fee is communicated to applicants by means of a calculation note. This is issued by the county directorates for agriculture, which are subordinated to the Ministry of Agriculture and Rural Development.
An important aspect to mention is the dynamics of these tariffs. Their value does not remain fixed from year to year, but is updated annually by order of the Minister of Agriculture and Rural Development. This update takes into account the inflation coefficient published by the National Institute of Statistics, thus ensuring that the tariffs reflect the current economic reality.
HOW MUCH DOES IT COST TO CONVERT A PIECE OF LAND FROM NON-URBAN TO URBAN IN ROMANIA?
For the year 2024, the cost of passing a plot of land from extravilan to intravilan is structured according to the class of agricultural land. According to the annex to the order, the rates indexed by the inflation coefficient are as follows:
i) for class 1 land: 4,416 lei/meter
ii) for class 2 land: 3,864 lei/meter
iii) for class 3 land: 3,312 lei/meter
iv) for land of class 4: 2,7600 lei/mp
v) for class 5 land: 2,208 lei/mp
These values have been calculated by applying an inflation coefficient of 10.4% for the year 2024, according to the data published by the National Institute of Statistics.
In order to calculate the total cost of moving a land from extravilan to intravilan, owners must multiply the surface area of the land, expressed in square meters, by the value of the tariff corresponding to the class in which the land is classified. This approach ensures a direct proportionality between the size of the land and the cost associated with the change in its status.
It is important to emphasize that these tariffs are not permanent. They are valid until the end of 2024, with the possibility of extension the following year. However, this extension is subject to the publication of the new inflation coefficient and the approval of the updated values by order of the Minister of Agriculture and Rural Development.
To sum up, the cost of converting land from extravilan to intravilan in 2024 depends on the surface area of the land and its class, varying between 2,208 lei/mp for class 5 land and 4,416 lei/mp for class 1 land. It is advisable to consult the county directorates for agriculture to obtain accurate and up-to-date information on the process of transferring land from extravilan to intravilan and the calculation of the related tariffs.
