A land register extract is an official document, issued by the Cadastre and Real Estate Publicity Office (OCPI), which provides detailed information about the legal status of a property. An extract from the land register is necessary for real estate transactions and administrative procedures, providing a clear picture of the real rights, encumbrances and other entries relevant to the real estate concerned.
The legal framework that regulates the land register extract is represented by the Law on Cadastre and Real Estate Publicity no. 7/1996, republished, with subsequent amendments and additions, as well as by the Regulation on the reception and registration in the cadastre and land register records, approved by the Order of the Director General of the National Agency for Cadastre and Real Estate Publicity no. 600/2023.
VALIDITY OF LAND REGISTER EXTRACTS IN ROMANIA
The validity of the land register extract varies according to its type and purpose, as specified in Order 600/2023. In the case of the land register extract for information, the legislation does not provide for a specific validity period. However, in practice, the various institutions and entities involved in real estate transactions or other administrative procedures usually require the most recent extract. This approach aims to ensure that the information contained in the land register extract reflects as accurately as possible the current legal reality of the real estate in question, thus minimizing the risks associated with potential recent changes in the cadastral-legal situation.
For the land register extract for authentication, the regulations are stricter. Requesting such an extract makes the cadastral number to which it refers unavailable for a period of 10 working days. This period starts from the moment the request is submitted, including the date, hour and minute, and ends at the end of the 10th working day. The purpose of this measure is to prevent changes in the legal situation of the immovable property in the interval between the request for the extract and the completion of the notarial procedure for which it was requested.
The validity of the land register extract for authentication ends in several situations
- on expiry of the validity period;
- at the time of registration of the application for registration of the notarial act for which it was issued;
- at the express request of the notary public who originally requested the extract.
These provisions ensure that the information used in the authentication process is as up-to-date and relevant as possible.
With regard to extracts issued in electronic format, either through the e-pay platform or through the integrated computerized cadastre and land registry system, they are, according to Art. 55 paras. (4) and (5) of the RULES of February 8, 2023 on the receipt and registration in the cadastre and land registers, valid exclusively in the electronic environment.
However, according to Art. 55 para. (6), their validity may also be extended to the physical form of the document, without a handwritten signature, with the express or procedural acceptance of the public institution or entity that requested its submission.
In order to verify the authenticity and up-to-dateness of the information, the electronic extracts are provided with an online verification code, valid for 30 calendar days from the generation of the document.
