Outbuildings without authorization in Romania

WHAT ARE THE HOUSEHOLD ANNEXES FOR WHICH NO BUILDING PERMIT IS REQUIRED IN ROMANIA?

A clear and specific definition of the term household annexes is elaborated in Annex 2 of Law 50/1991 on the authorization of the execution of construction works. Thus, according to the provisions of the aforementioned regulation, household annexes represent:

“Buildings of a permanent or temporary nature, intended to house specific activities, complementary to the dwelling function, which, by their location in the vicinity of the dwelling, form together with it a distinct functional unit”.

Also included in the category of household annexes, as a general rule, are:

  • summer kitchens;
  • stables for large animals;
  • cribs;
  • sheds;
  • storehouses and the like.

Similarly, garages, greenhouses, swimming pools and the like are also assimilated to the concept of household annexes.

Art. 11 of Law 50/1991, which lays down the hypotheses in which it is possible to build without a building permit, in para. (1) lit. n) refers also to household annexes by the expression “non-structural, demountable, light material, non-structural, dismantlable, compartmentalization alterations”.

Household outbuildings are therefore auxiliary buildings situated in the yard or on the land of a dwelling, used for various domestic or household chores such as storage, agricultural, workshop or animal housing. They are part of the household and contribute to the organization of the living space.

A building permit is only required for the construction of household outbuildings if the construction of the outbuilding requires foundations and walls, access to utilities or if the outbuilding to be built will serve as a livestock shelter. In all other cases, planning permission is not required.

Thus, any owner will be able to build as an annex to his dwelling, without the need for a permit, a construction with a roof that does not require a foundation, i.e. walls or other temporary light constructions that do not require a foundation such as:

  • gazebos, greenhouses without foundation, tool/weapon sheds, garages and other light constructions not requiring a permanent foundation.
